I am looking for someone, preferably a lawyer, who knows about the specifics of writing a petition for writ of mandate to the California Superior Court in regards to denied Unemployment Insurance Benefits.
There are lots of details to this "case" and in my last denial letter the board reviewing the matter stated that had I provided specific evidence, which I have but didnt know I needed, my claim would have been approved. Based on that statement I believe I have a very good chance of getting approved for benefits. Obviously there is much more to this which backs up my confidence.
I was "fired" in February. Prior to being fired I was approved for benefits, on a workshare program, for maximum benefits of $449 per week. this was prior to the economic stimulus which adds $25, so my weekly benefits should be $474 a week. I have a quot from a lawyer who wants $5000 to prepare the writ for me. He stated that it would take 15 hours at $300 per hour, plus an extra $500 in court fees and documents.
As I am sure you have summed up, I have been without income for over 8 months and dont have an extra $5000 laying around. All of the money I had saved was used to try and keep up on my monthly bills, keep food on the table for my kids, and keeping a little gas in the tank. Its amazing how quickly the reserves run out when there is no incoming! The way I calculate it I am owed over $18,000 in back benefits. By the time I am approved it could be over $20,000. I am willing to offer, on contingency of winning my appeal, a decent percentage of my first check from the EDD, well over the $5000 quote the other lawyer wants.
